Preamble

The website offers a selection of hotels with a privileged location and view (sea, mountain, etc.). Access to the Millevista.com website and the use of its content are subject to the present general conditions of use (hereinafter referred to as “General Conditions of Use”). By accessing and browsing the Strategy Voyages – Millevista website, the user constitutes unreserved acceptance of these Terms of Use. The latter being updated regularly, the user is invited to consult them at each visit.

Article 1 – Definitions

1.1 “Advertisers”: refers to any legal entity whose activity is the rental of hotel rooms on a professional basis.

1.2 “Content”: means any information, text, image or other content posted or uploaded to or appearing on the Site, regardless of its origin.

1.3 “Strategy Voyages – Millevista”: refers to the company Strategy Voyages – Millevista, a simplified joint stock company with a capital of €80,300, having its registered office at 48, Boulevard des Brotteaux – 69006 Lyon, registered in the Lyon Trade and Companies Register under number 382 608 420.

1.4 “Site”: refers to the Strategy Voyages – Millevista Internet site, accessible at the following address: www.millevista.com. The Site includes all computer components (in particular software and computer developments and web pages, including programs in source and object code, domain names, preparatory design work, specifications and preliminary studies, user documentation, database), the graphic charter (including projects, models, prototypes and plans), the content (in particular textual, graphic, sound, photographic and multimedia elements), as well as all related rights.

1.5 “User”: means any individual or any representative of a legal entity who consults the Site.

The terms mentioned above in the singular shall also be understood in the plural, and vice versa depending on the context.

Article 2 – Purpose

The purpose of the General Terms of Use is to define the terms and conditions under which Users use the Site.

Article 3 – Modifications to the General Conditions of Use

3.1 The company reserves the right to modify the General Terms of Use at any time, in particular to adapt them to changes in legislation, regulations or technical developments of the Site.

3.2 The General Conditions of Use are updated regularly.

3.3 In the event that the User does not agree with the modified General Conditions of Use, he/she must cease to access and use the Site.

The use of the Site by the User beyond the date of application of the new General Conditions of Use will be deemed to be acceptance of the latter by the User without reservation and expressly.

Article 4 – General operation / Interest of the Site

4.1 The Site is a reservation site that aims to present a selection of hotels with a privileged location and view (on the sea, the mountains, etc.) and packages of short stays with a theme

Within the limits set forth in these General Terms of Use, the Site allows the User to

to consult hotel advertisements
access the Advertisers’ websites via a hypertext link provided for this purpose
to book overnight stays or request a package through the site’s booking engine

4.2 The General Terms and Conditions are those of the site (available for consultation on the site and/or at the time of the reservation or request), the payment of a reservation is made on the site on behalf of the Strategy Voyages/Millevista agency, which manages the site’s reservations via the Amadeus solution.

Article 5: Connection and availability of the Site

The company makes its best efforts to ensure the availability of the Site. However, the User is informed that the availability of the Site is subject to a simple obligation of means. As such, the User may not in any case take advantage of a lack of availability. The Site may be subject to modifications resulting in temporary or permanent interruptions without notice. The User may not make any claim in this respect. Maintenance operations of the Site are also carried out periodically by the Company. In this context, the Company may have to temporarily interrupt access to the Site. The User is invited to inform the Company of any technical problem encountered while browsing the Site by describing the problem encountered by writing to the following e-mail address: contact@millevista.com.

Article 6: Strategy Voyages – Millevista intellectual property rights

The User acknowledges that the Site and the “MILLEVISTA / HOTELS WITH A VIEW” brands are protected by intellectual and/or industrial property rights belonging to Strategy Voyages – Millevista or to the group to which it belongs. The User is forbidden to take any action, any act likely to directly or indirectly infringe the intellectual and/or industrial property rights relating to the Site and the “MILLEVISTA / HOTELS WITH A VIEW” brands and to all the rights belonging to Strategy Voyages – Millevista and in particular to publish, reproduce totally or partially, distribute, adapt, both in France and abroad, all or part of the content of the Site and/or the “MILLEVISTA / HOTELS WITH A VIEW” brands Furthermore, the User is formally forbidden to use the technology and/or know-how and/or the content of the Site for commercial purposes with a view to creating one or more Internet sites and/or to offering similar services or services likely to compete with the Site.

Article 7: Responsibility of Strategy Voyages – Millevista

7.1 The content of an establishment as well as the reservation tunnel are recovered from the Amadeus API, the texts and images ONLY being able to be enriched by Strategy Voyages – Millevista. The information provided by the company on this site is for information purposes only.
The company cannot guarantee the accuracy, completeness or timeliness of the information provided on its site. Strategy Voyages – Millevista makes every effort to provide users with available, verified and updated information, but cannot be held responsible for errors, lack of availability of information and/or the presence of a virus on its site.
Consequently, the user expressly acknowledges that he/she uses the information contained in this site under his/her exclusive responsibility.

7.2 Strategy Voyages – Millevista will not be liable for any direct or indirect damages, losses or expenses resulting from the use of the site, or the inability to use the site, or from any malfunction, interruption due to maintenance, technical failure of the server hosting the site or related to an interruption in Internet access or for any other cause, virus, line or system problem.

7.3 Strategy Voyages – Millevista shall not be liable for any damage to the User’s computer system, loss of data, or any other damage that may result from the User’s access to or use of the Site.
Furthermore, Strategy Voyages – Millevista cannot be held responsible to the User for any loss or damage that he or she may suffer as a result of
– reliance on the completeness, accuracy or existence of any advertisement, information or video appearing on the Site or resulting from any relationship or transaction entered into between the User and any of the Advertisers whose hotel is listed on the Site;
– any change that Strategy Voyages – Millevista may make to the Site in general, or any temporary or permanent deletion of any element of the Site;
– any Content appearing on the Site;
– any conduct of any third party or other User on the Site generally, including but not limited to any defamatory, offensive or illegal conduct of other Users or third parties.

7.4 User acknowledges that access to and use of the Site generally is available and provided “as is” by Strategy Voyages – Millevista.
No claim may be made against the Site or Strategy Voyages – Millevista in this regard.
In particular, Strategy Voyages – Millevista disclaims any responsibility and does not guarantee that :
– the Content of the Site and/or the information on hotels, restaurants and villas appearing on the Site are complete, exhaustive, true, accurate and reliable;
– use of the Site will not be uninterrupted, timely, secure or error-free
– use of the Site meets the User’s needs;
– all Content respects the intellectual property rights attached thereto and in particular copyright.
No information that could emanate from Strategy Voyages – Millevista in the context of the use by the User, shall be considered as the granting of a guarantee.

Article 8: Illegal content

8.1 – Obligations of the User

The User undertakes to respect French law.

In this context, the User undertakes not to use the Site for illegal purposes and in particular, not to disseminate any message(s) or information whatever their form or nature:

– contrary to public order and morality ;
– contrary to the respect of private life;
– offensive, defamatory, racist, xenophobic, revisionist or damaging to the honor or reputation of others, inciting discrimination, hatred ;
– threatening a person or a group of persons;
– of a pornographic or pedophilic nature;
– inciting to commit a crime, a misdemeanor or an act of terrorism or glorifying war crimes or crimes against humanity;
– inciting to suicide;
– violating the legislation on the secrecy of correspondence, or, in general, contrary to a regulation in force or a law in force.

In the event of a breach by the User of these obligations, Strategy Voyages – Millevista reserves the right to remove the offending Content without the User being entitled to claim any compensation and without prejudice to any damages that Strategy Voyages – Millevista may seek in compensation for the loss suffered as a result of such breach by the User.

8.2 – Reporting illegal Content

Any User wishing to bring to the attention of Strategy Voyages – Millevista the presence of information or Content that is illicit, infringing in particular the intellectual property rights of a third party or contrary to a legislative or regulatory provision, may do so by sending a detailed e-mail to the following address: contact@millevista.com

In accordance with the terms of article 6-I-5 of the law n° 2004-575 of June 21, 2004 for the confidence in the digital economy (LCEN), the said notification will have to mention the following information:

– the date of notification ;
– if the notifying party is a natural person: his name, first name, profession, address, nationality, date and place of birth;
– if the notifier is a legal person: its form, its name, its registered office and the body which legally represents it;
– the name and address of the addressee or, if it is a legal person, its name and registered office;
– the description of the litigious facts and their precise location (e.g.: URL link of the litigious advertisement);
– the reasons for which the content must be withdrawn, including the mention of the legal provisions and the justifications of facts;
– a copy of the correspondence addressed to the author or publisher of the litigious information or activities requesting their interruption, withdrawal or modification, or the justification – that the author or publisher could not be contacted.

In addition, pursuant to the provisions of Article 6-I-7 of the Act of June 21, 2004, LCEN, Strategy Voyages – Millevista provides Users with an easily accessible and visible device allowing any person to bring to its attention illegal data relating to the apology of crimes against humanity, incitement to racial hatred and child pornography, incitement to violence and offenses against human dignity by sending an e-mail to the following address: contact@millevista.com

Article 9: Data protection and cookies

9.1 Personal data

In accordance with the data-processing law and freedom of January 6, 1978, the treatment of the personal information collected on the site millevista.com was the subject of a declaration near the CNIL under the number 2003219v0. You have the right to access, modify, rectify and delete data concerning you. To exercise this right, you must send a letter to :

9.2 Cookies used for audience measurement and session cookies

By depositing a cookie on the User’s computer, information is collected that makes it possible to know how the User has accessed the Site and how he or she uses it (for example, times of connection and navigation on the Site, pages visited). Strategy Voyages – Millevista also collects the User’s IP address in order to determine the city from which the User is connecting. This IP address is deleted or anonymized once the geolocation is completed. This cookie is kept for a limited period of six (6) months.

Article 10: Applicable law – Competent jurisdiction

If the User is a professional merchant, the exclusive jurisdiction to hear all disputes relating to the interpretation or execution of the General Conditions of Use is the Commercial Court of Lyon.

Attribution of competence clauses
This site being governed by the French law, only the French courts will be competent in case of litigation.
